Membership, Subscription and Fees
Membership tiers and inclusions
Tier 1, Tier 2, Remote: each tier’s inclusions are described on the program sales page and in your enrolment confirmation. You are responsible for reviewing the inclusions for your chosen tier at enrolment.
Billing and payment
Payment methods: major credit cards, direct bank transfer, PayPal and AfterPay.
Recurring billing: fees are charged on a monthly subscription cycle unless a fixed-term or alternative arrangement is agreed in writing.
Failed payments: you remain liable for any unpaid fees, and we may suspend access to the member portal and live services until payment is received.
Price changes and promotions
We may change membership fees, packages, or promotions. Changes affecting ongoing subscriptions will be notified at least 14 days before the next billing date.
Upgrades, downgrades and prorating
Tier transfers take effect on the next billing cycle. We will prorate charges for the remainder of the billing cycle when you upgrade or downgrade.
Cancellation and refunds
Cooling-off and refunds: Full refund available if you cancel more than 14 days before your start date. Monthly subscriptions are cancellable; cancellation requests must be received before the next billing cycle to avoid subsequent charges. No refund or credit for cancellations within 7 days of a billing cycle, except where required by law.
Transfers: If you cannot attend, you may transfer your spot to another eligible candidate subject to administrative approval.
Access, Program Delivery and Conduct
Access to services
In person and livestream: in-person sessions run at scheduled times; remote members receive livestream links and recorded sessions as indicated in the membership inclusions.
Member portal: after checkout you must complete the enrolment form to activate your member portal where programming, testing forms and session schedules are delivered.
Program changes and roll-on enrolments
Programs are phased and allow rolling enrolments; new entrants will complete the Testing block (Phase 1) to establish baselines and an individualized ramp-up plan. We may modify phase dates, session times, or formats for operational reasons.
Code of conduct
Members must follow coach guidance, respect other participants, and not disrupt sessions. We reserve the right to suspend or terminate membership for abusive behaviour, repeated failure to follow safety instruction, or conduct that endangers others.
Health, Screening, Equipment and Risk Acknowledgement
Pre-participation requirements
Before commencing you must complete our medical screening and testing forms and declare any current injuries, chronic conditions, medications, or medical limitations. We may require GP clearance for high-risk conditions prior to participation.
Equipment and personal responsibility
Members are responsible for providing the equipment listed on the sales page (e.g., sturdy pack 28 kg loaded, 8 kg webbing, boots, running shoes). You must ensure equipment is serviceable and appropriate for the planned activity.
Assumption of risk
Selection training is physically demanding and carries inherent risks including serious injury and death. By enrolling you acknowledge these risks, confirm you are voluntarily participating, and warrant that you have disclosed relevant medical information to Way-finder.
Liability, Waiver and Indemnity
Release and waiver
To the maximum extent permitted by law you release Way-finder, its officers, contractors, coaches and agents from any liability for personal injury, death, property loss or damage arising out of or connected with your participation, whether caused by ordinary negligence or breach of contract.
Limitations under Australian law
Certain liabilities cannot be lawfully excluded. A waiver will not affect liability for gross negligence, wilful misconduct, or liabilities that cannot be excluded by applicable law. It is recommended that members seek independent advice if they are uncertain about these provisions.
Indemnity
You indemnify and hold Way-finder harmless from any third-party claims, loss, damage, cost or expense arising from your breach of these Terms or your negligent or reckless acts during participation.
Insurance
We maintain public liability insurance appropriate to our operations. Members are encouraged to hold personal accident, income protection and private health insurance suitable to their circumstances.
Privacy, Intellectual Property and Contact
Privacy
We collect and use personal information for enrolment, program delivery, safety screening and billing. We handle personal information in accordance with applicable privacy laws. By enrolling you consent to our use of your information for these purposes.
Intellectual property
All program materials, training plans, videos and resources are the intellectual property of Way-finder. You are granted a non-transferable, non-exclusive licence to use program materials for your personal training only. You must not reproduce, share, sell, or otherwise distribute materials without written permission.

General Provisions and Governing Law
Severability and amendments
If any provision of these Terms is invalid or unenforceable it will be severed and the remaining provisions will continue in force. We may amend these Terms; material changes will be notified to you before they take effect.
Governing law
These Terms are governed by the laws of New South Wales, Australia. Disputes will be subject to the jurisdiction of the courts of New South Wales.
